House Awards Millions in Medical Malpractice Lawsuit

A Broward family and a girl left paralyzed after spinal cord surgery, may soon be able to claim their medical malpractice award.

Following surgery in 1989, the girl was left paralyzed from the waist down after an operation on her spine when she was only six months old. She was born with spina bifada, a congential defect in which the spinal cord fails to properly close.

In 1999, a jury found the operation wasn't necessary and caused her to lose the use of her legs. The family, was awarded $8 million in the suit, but has been unable to cclaim the money because state law caps payments at $200,000 unless legislature approves otherwise.

The Florida House, on Tuesday, approvved the jury awarded amount. Now it goes to Senate for a vote.
